#Trademark practice - How to calculate the deadline of filing a response to a notification of refusal concerning international trademark registration extending to China?
Nowadays, many applicants will file their trademark application via the Madrid route, then extend the protection to other countries. However, the trademark examinations are different in each country, it is not surprising to receive notification of refusal sometimes. If so, how to calculate the deadline to respond? Some clients said they search online, some answers are 15 days, while some others are 30 days. Lately, we got several inquiries about this same question. Now I'm making an explanation about the situation here in China. Most of the notifications were received online. But still, there is a period of 15 days of virtual mailing time. Then the Trademark Office gives the applicant 15 days to take further actions. The total is 30 days. So when the same question pops out next time, you can just check the issued date on the notification, and add 30 days to it, then you will have the right answer.
