#Patent practice - Whether your CN patent was terminated?
I got a question from a client several days ago. Quoting - "Can you tell me the time limit for reviving a Chinese patent? I wanted to ask for a confirmation/clarification of the Chinese law for reviving a lapsed patent (failure to pay an annual fee)." In case you have a similar question, please check my explanation below: 1. If you failed to pay the #annuity, within six months counted from the deadline, he/she can still go with the delayed payment; 2. If the delayed payment period is passed, then the Patent Office will issue the Notification of Termination of Patent Right. Within two months counted from the date of receiving this notification, you can still revive the application. To a foreign applicant, it might be hard to predict when he/she will receive the notification, the general practice is adding 15 days of virtual mailing Time.
